Judicial Panel to Reconsider Decision That Permitted Trump to Send Military Forces to Oregon City

Appeals Court Concurs to Rehear Case
The ninth circuit court of appeals decided on this week that it would rehear the legal dispute concerning the executive power with an expanded panel of 11 judges. The judicial body also overturned a earlier ruling from a smaller judicial group that had sided with the administration.
Legal Saga Over Troop Deployment
This order represents the latest turn in a protracted legal battle over whether the former president has the authority and valid reason to deploy national guard forces in Portland. Approximately two hundred troops have been in uncertainty since late September when the deployment effort was started in due to months of protests.
Conflicting Arguments
The administration has claimed that federal officials at the ICE facility in south Portland were under attack, while local authorities maintain that municipal police have command of the situation.
In defiance of descriptions of the city as “war ravaged”, residents have been posting footage of scenic paths and a vibrant culinary culture, and planning events such as an Emergency Naked Bike Ride against the “militarization of our city”.
Recent Legal Actions
The Tuesday ruling came after a federal judge in Portland enacted two temporary restraining orders this month – one blocking the federal control of the Oregon national guard, and another prohibiting the use of any national guard troops in the state, after efforts to evade the first order by mobilizing troops from California.
On Monday, the appeals court had put the first ruling on hold – permitting command of state troops – but the second ruling remained in place, blocking the physical sending of the forces.
Full Panel Consideration
The Tuesday decision means the issue will be heard by the full court – with all decisions under review together – by a panel of 11 judges.
“This ruling shows that the truth matters and that the courts are working to hold this administration accountable. The constitution restricts the executive authority, and Oregon’s communities cannot be treated as a training ground for unchecked federal authority,” said the state attorney general in a official comment.
“The judicial body is sending a definite signal: the executive leader cannot dispatch the military into US cities unnecessarily. We will continue protecting state legislation, values, and autonomy as this case progresses and our fight continues in the judicial system.”
